The CPT reiterates that freedom of expression is guaranteed and protected, in accordance with the Constitution, international treaties ratified by the Republic of Haiti, and the laws, but qualifies this by stipulating that this freedom of expression must be exercised "[...] with respect for human dignity, public order, national security, public health, the protection of youth and children, heritage and social values, as well as the fundamental rights of others." This offense, committed by the same means against a person or group of persons on account of their origin or their membership or non-membership of a particular ethnic group, Nation, race, or religion, or on account of their political opinions, is punishable by imprisonment for two (2) to three (3) years and a fine of fifty thousand (50,000) to one hundred thousand (100,000) gourdes.
