Haiti - Social : National Plan for the Regularization of foreigners in the Dominican Republic
The organizations of civil society, according to what is prescribed by law have been invited to make recommendations for implementing the National Plan for the Regularization of Foreigners (PNRE). IOM as international entity specializing in this area, member organizations of the Jacques Viau Network and of the Table of migration, as well as the Foundation Zile (FZ), are among the limited number of organizations that responded to the invitation of the Directorate General of Immigration (DGM).

In the case of the organizations mentioned, their recommendations are on aspects more technical, such as documents that should be considered to prove the residence time, even illegally in the Dominican Republic. The FZ instead made ​​general recommendations for a better implementation of the Plan. All the recommendations will be analyzed at the next meeting of the National Migration.

A copy of document was sent to the Ministries of Haitians Living Abroad and Foreign Affairs. The PNRE as designed is an unprecedented initiative in the Dominican Republic, fruit of the struggle of community organizations over the past 30 years. The involvement of the Haitian government is essential.

NATIONAL PLAN FOR REGULATION OF FOREIGN (PNRE) :

"Taking into account the provisions of immigration law 285-04 and at the invitation of the Directorate General of Immigration (DGM) to civil society organizations to submit proposals to develop the National Plan for the Regularization of Foreigners (PNRE), the Foundation Zile (FZ), an entity legally constituted as a space of promotion of solidarity and the cooperation between the Republics of Haiti and Dominican, has the privilege to make the following recommendations relating to procedures or the implementation of the plan.

PARTICULAR ATTENTION TO HAITIAN IMMIGRANTS :
It is true that the PNRE is an initiative open to all foreigners who are currently in irregular migratory situation on the Dominican territory, undoubtedly and for many factors, Haitians are the majority. Thus, the FZ recommends special attention to the members of this community. Besides the use of Creole in an information campaign before the launch of the plan, all application forms and other documents, and newsletters of DGM in traditional media, web or printed version should have a creole version as a second language after Spanish.

The FZ is joining to other organizations to request and seek the direct involvement of State / Government of Haiti as a provider of essential documents for the benefit of those nationals, PNRE candidates, through a special agreement with the Dominican government. he FZ also recommends the organization of an information workshop on the process, at least one month before it starts, for leaders of the Haitian community in the Dominican Republic in order to help them to guide as well as possible their compatriots on the Plan.

STOP OF THE REPATRIATION :
The operations of repatriating that have been frequently questioned in the local and international level are not compatible with the PRNE. The DGM should now publish a notice of closure of repatriation until the end of the regularization process. It is understood that the deportations for the reasons specified by law are not concerned by this recommendation.

FREEDOM OF TRANSIT FOR UNDOCUMENTED :
Most Haitian immigrants who would benefit from PNRE do not have the required documents for legal residence and free movement, especially those living in border areas. There are military checkpoints, where they are often detained, sometimes repatriated. To meet the requirements of the Law on Immigration and of PRNE, they will be forced to move for administrative procedures. The FZ suggests, according to the agreement to be established with the Haitian government in order to facilitate the freedom of transit, that it is issued, on an individual basis by the Consulate of Haiti in the Dominican Republic, a road map showing that the wearer moves as part of the proceedings related to PNRE. On the other hand, the FZ supports the suggestion of other organizations, that the provincial delegations and mobile units of the DGM, are used for various aspects of the plan, thus reducing the traveling distances.

EVALUATION PROCESS :
Taking into account similar operations conducted in other parts of the world, including Europe and North America, whose results sometimes have not fully met the objectives set for legal migrants in social and economic aspects, and in this case, considering that 2012 is an election year in the Dominican Republic, with a change of administration in August, which we hope will not affect the PNRE, the FZ recommends a thorough evaluation exercise, three months after the launch of the process, with the participation of key stakeholders, in order to take corrective action if necessary, and to facilitate the transmission of this important issue to future leaders.

The FZ by supporting sister organizations about technical recommendations on other aspects of the process reiterates its willingness to cooperate in the fields of its competence, with official bodies of the two countries for the success of PNRE. Also, it is committed to providing special support to the leaders of the Haitian diaspora organizations in the Dominican Republic."
