Haiti - NOTICE : Standing Magistrates, strike prohibited

Me Carlos Hercule, the Minister of Justice asks the various bodies and institutions working in the judicial sector to contribute to the fight against banditry and serious crime, in accordance with the provisions set out in the decree establishing a state of security emergency in certain municipalities and localities in the departments of the West and Artibonite, referenced in Le Moniteur of July 17, 2024 https://www.haitilibre.com/en/news-42832-haiti-security-municipalities-and-localities-affected-by-the-state-of-emergency-list.html

Given the requirements of the state of security emergency and referring to the provisions of Article 55 of the law of November 20, 2007 on the status of the judiciary, which provides : "Judges and Officers of the Public Prosecutor's Office may organize themselves to make their demands known, without their demonstrations undermining the continuity of the public service of justice. Any concerted action aimed at obstructing the course of justice or having the effect of restricting the rights and freedoms of citizens is prohibited", the Ministry of Justice and Public Security orders the Government Commissioners and the Deputy Commissioners of the various jurisdictions of the Republic to put an end to their strike movement.

This serves as a warning.

Carlos Hercule

Minister of Justice"

Let's recall that in its latest report published at the end of July https://www.haitilibre.com/en/news-42890-haiti-flash-one-victim-every-72-minutes-in-haiti.html , the United Nations Integrated Office in Haiti (BINUH) emphasizes that the paralysis of the judicial system has also continued due to violence and repeated strikes by magistrates and judicial staff. Since the beginning of the judicial year (October 2023), the courts and tribunals have been functional for barely 10 days.
