Haiti - Justice : Justice violates the law, in Petit-Goâve

The President of the Bar of the Bar Association of Petit-Goâve, Me Patrice Cadet denounced, in a press release sent to the newsroom of Radio Préférence FM, that the Judge/Dean Me Fritzner Duclair, the substitute of the Government Commissioner to the Court of First Instance of Petit-Goâve, Me Pierre Wilner Dormevil and the Deputy of Léogâne, Jean Danton Léger, have violated the law at a criminal audience with assistance of juries, which was held in the courtroom of First Instance of Petit-Goâve Wednesday, July 24.

Me Patrice Cadet mentions that "Me Fritzner Duclair authorized the Deputy Me Danton Léger to defend Mr. Michel Alexandre, accused of murder on the person of Joseph Yva in violation of Article 30 of the Decree of 29 March 1979 regulating the practice of the legal profession which states : are incompatible with the exercise of the legal profession, all the functions of members of the legislative body [...]

Furthermore, he mentions that Me Fritzner Duclair had categorically refused to allow him to speak while he would make a statement against the Deputy Danton Léger and against Me Pierre Wilner Dormevil who had intervened to ask to Me Mickson Michel, a trainee lawyer to avoid from rubbing with Me Léger and ordered to the bâtonnier to sit : it is an order, bâtonnier, sit !

[...] By letting the Deputy Me Léger, plead to criminal audience with the support of a judge standing, Me Fritzner Duclair committed a serious deviation and attacked all the bars of the Republic," precise Me Patrice Cadet in a statement, demanding that action be taken against the offending behavior of Magistrates.

To this end, members of the Disciplinary Board and all barrister of Petit-Goâve, are convened to the extraordinary to a meeting on July 31, 2013 and August 1, 2013, to fix their position on this unfortunate incident.
