Haiti - Justice : The CSPJ formally requested the assistance of the Executive

Remember that since several months, the members of the Superior Council of the Judiciary (CSPJ), is looking for a solution to try to obtain the resignation of 3 first representatives of the CSPJ, installed by Presidential Decree at Permanent Electoral Council (CEP) [for 10 years] after an election contested, July 24, 2012.

Last week, the Head of State had declared "The Executive respects the independence of the judiciary, so it did not intervene to date, to ask anything at this level [...] I've already asked twice to the President of the Court of Cassation [Me Anel Alexis Joseph, who is also President of the CSPJ], to send me a letter in which he admitted his inability to resolve this situation within the CSPJ, so that the Executive can assist in resolving this crisis."

Monday, February 18, 2013, the President Michel Martelly, has finally received a letter, signed by Me Anel Alexis Joseph, President of CSPJ, informing him of the inability of the Council, to find a favorable outcome to the crisis within this institution, having regard to the appointment of three members currently installed and in function at CEP, information provided by the Office of Communication of the Presidency.

The President of the CSPJ has also formally requested of President of the Republic his intervention to help the Judiciary to out of this impasse.

Also, the Head of State, guarantor of the proper functioning of institutions, soon informed, has issued an invitation to representatives of the Superior Council of the Judiciary installed to the CEP, in order to discuss the situation and find the most appropriate solution.

However, within the CSPJ some members seem unaware of the approach of Me Anel Alexis Joseph and do not want to comment on this information, pending clarification.

For his part, Me Durin Duret, President of the National Association of Magistrates of Haiti (ANMAH) believes that Me Anel Alexis Joseph can not, without consultation with the other members, commit personally the CSPJ.
