Haiti - Justice : 3rd postponement of the session of appeal against former President Duvalier

Originally scheduled January 10, 2013, the session of appeal against former President Jean-Claude Duvalier, following the controversial conclusions of the Closing Order, of the Judge Jean Carves, who had dropped the charges for violation of human rights, had been postponed a first time January 24, 2013, at the request of the victims' lawyers, who believed that legal procedures had not been followed. On 24 January the session was postponed a second time, to Thursday, January 31, due to the death [due to illness], of one of the judges of the Court of Appeal, Enock Voltaire.

Thursday, January 31, "Baby Doc" who was not present, had been represented by his lawyers, not having "the obligation to appear physically in court" as pointed out by one of his lawyers after the announcement of the second postponement, but that the former president "would will present if the Court ordered him to do."

Jean Joseph Lebrun, President of the Court of Appeal did not rule Thursday on this appeal and postponed the session at 7 February 2013, saying at the delivery of his postponement, that the presence of Jean Claude Duvalier, was now required.

Following this third postponement Me Reynold Georges, confirmed "The judge postponed the case for one week, he requires that the former President to appear before the court, then he will appear on February 7th."
