Haiti - Justice : 8th new Commissioner of the Government...

Joseph Guyler C. Delva, the Secretary of State for Communication announces that Me Luckmane Délille, the new Commissioner of the Government near the Court of First Instance (TPI) of Port-au-Prince was sworn, Tuesday, October 30, at a ceremony chaired by Me Raymond Jean Michel, Dean of the TPI. The ceremony was held in the presence among others of : Me Jean Roudy Aly, Director General of the Ministry of Justice, Jean Renel Sanon, the Minister of Justice, Dr. Jean Robert Nereus, Chief of Staff of the Minister of Justice and several members of private office of the Minister.

Me Delille, replaces to this position, Me Elco Saint-Amant whose function was performed by Acting by Me Gérald Norgaisse. It is the 8th Government Commissioner in 17 months and the fourth in less than 2 months. The new Commissioner inherits of the case "Clifford Brandt."

Dr. Jean Robert Nérée reminded the new Commissioner, that the rule of law advocated by the Government Martelly-Lamothe, should lead to a proper application of its penal policy.

Just before the swearing in, the dean of the TPI informed the new Commissioner of the fragility of its new duties. "Do not be surprised if your former colleagues, which today greet you warmly, become tomorrow the first to slander you."

Me Luckmane Délille declared yesterday "It is with honor that I answer the call of the power to replace Me Gérald Norgaisse who kindly perform this function by acting [...] my priority is the juvenile delinquency, beggars around banks, kidnappers and bandits who want to destabilize the country, prolonged pretrial detention [...] everything that the old government commissioner did, we will walk on the same track, to give a response to the population [...] concerning the preventive detention, I'll try to find out who committed minor crimes, petty theft, things that are not serious... and which are in prison for several months, we will review their record, we'll find a way to release them. Prisons are there for notorious criminals and bandits that prevent citizens sleep well in the country [...] to the kidnappers I would say that the ball ended [...] justice should strike terror in the camp of bandits [...]"

Regarding the fight against preventive detention, the new Commissioner will have a lot of work to do, n fact, on 8572 people are currently imprisoned in Haiti, 6170 are in custody. In Port-au-Prince (40% of the prison population of Haiti), he rate of preventive detention is 90.48% !
