Haiti - Justice : A summons that did not exist !

Me Michel and Me Saint-Juste the lawyers of the former mayor of Port-au-Prince, Muscadin Jean Yves Jason, have summoned to appear to the Parquet of Port-au-Prince, Jean Renel Sénatus, the Government Commissioner, in order to obtain clarification on the summons that would have been issued against their client, as part of the investigation on the fire of market of Port [June 18].

On Monday, the Government Commissioner of Port-au-Prince, appeared in the office of investigating judge Me Jean Carves, in order to respond to the assignment of lawyers of the former mayor. In a habeas corpus hearing, the Judge Jean Carves said he never received from prosecution the summons, that would indicate that the freedom of Mr. Jason was threatened. Consequently, the magistrate stated that the approach of lawyers of the former mayor was incorrect.

"We will signify this decision to the police who can no longer attempt to arrest our client," have informed Me Michel and Me Saint-Juste.

After that hearing, lawyers of the former mayor have declared that the Commissioner Sénatus had admitted before the judge Carvez Jean, that there was no mandate against their client, contrary to previous information obtained from the Office of the Commissioner of Government and reported by the two lawyers, who had affirmed at the time, "have been surprised to learn that their client would be arrested and that police forces would be sent to his home to bring it to the prosecution." Me Sénatus, would at thi anterior meeting asserted that the absence of Mr. Jason to his convocation, justified the application of the law...
