Haiti - Justice : D-Day for CSPJ

After the announcement made last week by the President Martelly, the Prime Minister, Laurent Lamothe confirmed in turn, on the sidelines of the Special Council of Ministers, held yesterday Monday at the National Palace, that the members of Superior Council of Judicial Power (CSPJ) will be officially installed this Tuesday, June 3, 2012 This is great news that goes in the direction of the establishment of the rule of law. By Tuesday the Superior Council of Judicial Power will be functional."

During the last two weeks, several meetings were held between teams from the Ministry of Justice and Public Security (MJSP) and the CSPJ particularly around the issues of development of premises of Council [which will have its offices at the School of Magistrates], of transfer of skills and the operating budget.

Arnel Alexis Joseph, the President of the Court of Cassation recalled that before the coming into office of members of CSPJ there had never been effectively three powers in Haiti, the Constitution has never been respected, the judiciary had always been a "power under" the Executive.

Me Anel Alexis Joseph : President of the Court of Cassation,

Me Antoine Norgaisse, Judge at the Court of Cassation : vice President

Me Thiers Malette, Government Commissioner at the Court of Cassation

Me Max Elibert, elected by its peers (Judge at the Court of Appeals of les Cayes)

Me. Gustave Pharaon, elected by the Courts of First Instance of the Republic (Dean of the tribunal of First Instance of Gonaïves)

Me. Jean Alix Civil, chosen by the Minister of Justice (Government Commissioner of the Court of First Instance of Petit Goâve)

Me. Jean Etienne Mercier, Representative of the judges of the courts of peace of the Republic (Judge of Peace of Delmas)

Me Dilia Lemaire, Representative of civil society

Me. Néhémie Joseph, Representative of the Assembly of barrister in exercise (Dean of the Bar of Gonaïves)

Durin Duret, the President of the Association of Haitian Magistrates (Anamah), who welcomes this announcement has insisted that the international community had played no role in this installation, but it was only the result obtained by national actors, who fought for the independence of judiciary. He recalled that the Association of Magistrates will remain vigilant on the issues, of the independence of CSPJ and of skills transfer of the Ministry, two key aspects to restore public confidence.

The inauguration ceremony of members of CSPJ will be held at 9:30 this morning at the School of Magistrates.
