Haiti - Hinche : OFATMA forces the closure of 3 construction sites 11/01/2026 08:41:32
According to information gathered, OFATMA inspectors observed clear and repeated resistance from construction site owners, characterized by their persistent refusal to comply with legal obligations regarding worker registration with OFATMA, despite several prior formal notices. Faced with this defiant attitude, which they likened to defiance of the law, the competent authorities ordered the immediate closure of the construction sites to put an end to practices deemed contrary to the legal provisions governing social protection and workplace safety. The operation was conducted under the supervision of judicial authorities, in the presence of officers from the Haitian National Police (PNH), to ensure compliance with legal procedures and prevent any disturbance of public order. The individuals in question are suspected of having exposed their workers to significant risks by having them work without any legal coverage against workplace accidents and other risks related to construction site activities. OFATMA describes this situation as a serious violation of workers' fundamental rights. The institution reiterates that Haitian law requires all employers, without exception, to declare their employees and pay the required social security contributions. Failure to comply with these obligations, when compounded by blatant defiance of public authority, exposes offenders to severe administrative penalties and potential legal action. Legal proceedings are currently under consideration, while the resumption of activities at the affected sites remains strictly contingent upon full regularization in accordance with current legislation.
