Haiti - Justice : 91 Democratic Members of Congress Defend Haitian TPS

91 Democratic members of Congress have filed a brief with a federal lower court judge, requesting a ruling in favor of Haitian immigrants.

On Monday, September 15, 2025, Senator Edward J. Markey (D-Massachusetts) and Representative Sheila Cherfilus-McCormick (D-Florida), leading 89 lawmakers, announced that they had filed an amicus curiae brief in the District Court for the District of Columbia in the case of Lesly Miot v. Trump. The filing challenges the Trump administration's decision to terminate Temporary Protected Status (TPS) for Haiti.

The lawmakers are asking the court to halt the program's termination. In their petition, they warn that if the termination is upheld, "it will not only be a betrayal of the American promise; it will be a blow to American interests."

In making the announcement, Senator Markey highlighted the deteriorating situation in Haiti. "The humanitarian crisis in Haiti is dire and worsening, and Haitian TPS holders are unable to return home safely," he said.

Representative Cherfilus-McCormick, who represents the 20th District in South Florida, spoke of her personal commitment to this issue : "I understand firsthand how vital TPS is for families fleeing Haiti’s ongoing crises [...] I’m proud to stand with Senator Markey and advocates to protect Haitian nationals; This is about more than policy; it’s about people’s lives. I will continue fighting for a just and compassionate immigration system that safeguards the Haitian diaspora."

In their request, the lawmakers emphasized that Haitian TPS recipients "participate fully in the economic, social, and community life" of the United States. They highlighted their contributions not only to key sectors of the economy, but also to civic and cultural life.

The amicus curiae warns that the mass deportations planned by the Trump administration would endanger the safety and integrity of families, separate parents from their children, and deprive local communities of essential workers.
