On Monday, Dec. 19, 2022, prosecutors in 19 Republican-led U.S. States filed an emergency appeal to the Supreme Court asking to block the decision of the federal judge in Washington, who required President Biden to end a the application of "Title 42", a health ordinance implemented in March 2020 by the Trump administration in the name of the fight against the pandemic which allows the deportation of potential immigrants including potential asylum seekers.

In an order signed by Justice John Roberts, President of the United States Supreme Court granted them satisfaction and temporarily suspended the withdrawal of "Title 42" scheduled for Monday before midnight. In his order, Judge Roberts also asked the Department of Justice to respond to this question by Tuesday evening.

But for now, this Supreme Court ruling forces the Biden administration to leave border restrictions in place while the High Court considers whether to address the longer-term 19-state claim...

The U.S. Department of Homeland Security (DHS) confirmed late Monday that the public health order remains in effect as required by the Supreme Court's administrative stay, noting that "those who attempt illegally entering the United States will continue to be deported to Mexico".

Louisiana Attorney General Jeff Landry finds this suspension "particularly appropriate" given "the enormous harm that would otherwise be inflicted on the United States" with the massive influx of migrants. Arizona Prosecutor Mark Brnovich agrees and believes that "the number of cross-border migrants could double" if "Title 42" were lifted.

The major migration policy change is expected to overburden the already strained southern border, whose asylum processing system is unable to meet demand and thousands of migrants appear to have gathered along the border between the United States and Mexico pending the lifting of "Title 42".

For his part, the Mayor of El Paso, Texas, declared a state of emergency last weekend, doubting the ability to handle the influx of people who will want to enter the United States.
