Me Ocnam Clamé Daméus, the Government Commissioner at the Court of First Instance of Port-au-Prince after the failure of a first convocation, again convened Marie Margareth Fortuné, the Director General of the Lottery of the Haitian State (LEH) to explain about denunciations and allegations of alleged corruption, carried against her by alleged agents of the institution, voluntarily ignoring the legal constraints of this convocation.

In a courteous and didactic letter, while being open to explain, Marie Margareth Fortuné once again explained to Commissioner Daméus the legal obstacles that prevent her from responding to this convocation.

Letter from Margareth Fortuné :

« [...] Mr Commissioner,

By letter dated September 17, 2018, you convened me to your prosecution following serious denunciations of presumption of bribery of which I would be the object by public officials assigned to the institution I head at benefit of the Haitian state.

By responsive letter dated September 21, 2018 https://www.haitilibre.com/en/news-25606-haiti-justice-convened-the-dg-of-the-state-lottery-stands-up-to-the-commissioner-of-the-government.html , I had taken the trouble of informing you of all the legal obstacles, as a Senior State Official, which prevent me from answering this convocation.

Despite these legal obstacles that I had the opportunity to notify you, you had decided, by letter dated September 20, 2018, to reaffirm your convening without taking into account what the Decree of 23 November 2005 establishing Organization and Functioning of the CSC/CA, the Haitian Penal Code and the Code of Criminal Instruction with regard to the procedure to be followed in this respect.

In addition, as State woman, respectful of Republican Institutions and Laws of the Country, I have the advantage to bring to your attention that I had sent a correspondence to the President of the Republic, His Excellency Mr. Jovenel Moïse to solicit, according to the wish of the Code of Criminal Instruction, his authorization to present me in your Procuratorate on the scheduled date. You will find attached to this letter a true copy of the said correspondence.

Pending the authorization of the President of the Republic, I take this opportunity to renew to you, Mr Commissioner, the expression of my greetings.
