Haiti - Elections : Death of the candidate Jean-Pierre Arincks (UPDATE 19-03-2011)

Jean-Pierre Arincks, candidate to the deputation for the constituency of Terrier Rouge under the banner of AAA (Ayit An Aksyon) who was to face on March 20th, to the candidate Pierre Jocelyn (UCADDE), died Monday following a discomfort during his transport to the hospital of Trou du Nord.

Article 56 :

In case of death or mental incapacity duly established or declared of one of the candidates before the first ballot, he is replaced by another candidate nominated by his political party, political grouping or regrouping of political parties, under the conditions provided in Article 51 of this Law.

Article 56.1 :

If these circumstances occur after the first round for a candidate admitted to the second round of the voting, the Permanent Electoral Council sets elections for the constituency concerned with the candidates and political parties, political groups or groups of registered political parties.

The decision of the CEP

The Provisional Electoral Council informs that following the request of political parties involved in the Press Release # 83 concerning the death of Mr. Arincks JEAN PIERRE candidates for deputy for the constituency of Terrier Rouge and after deliberation by the Council it was decided to apply the Article 91.2 of the Electoral Law.

Consequently, the Party concerned is invited to attend as soon the BEC of Terrier Rouge to register a replacement candidate.

The second round will be held this Sunday, March 20, 2011 between the candidate that the AAA will have designated and that came in second, Jocelin PIERRE, UCADDE. The ballot was already printed, voters will vote for the candidate already registered, in accordance with Article 91.2 of the Electoral Law.

Article 91.2:

The political party, political grouping or regrouping of political parties, whose a candidate dies or becomes mentally incapacitated, duly noted or declared, has the right to a new candidate for the seat to be filled within a period not exceeding fifteen (15) days before the election day to submit a candidate by declaration to the BEC or BED. If the ballot is already prepared, the voters vote for candidates already registered.
