Haiti - NOTICE : Electoral campaign, it's time to submit a detailed report

Uder Antoine, the Executive Director of the Provisional Electoral Council (CEP), reminds political parties and groups of their obligation to respect scrupulously the provisions of articles 125 to 135.2 of the Electoral Decree of 2 March 2015, dealing with the financing regime, both public and private, of the electoral campaign.

The Council considers it necessary to recall also the content of Articles 128 and 135 of the Decree making obligation for political parties to submit a detailed report on the subsidy received from the State as well as all donations from private funding.

Article 128 :

"Thirty (30) days after the publication of the official results, the party, political group that has received a State subsidy, is obliged to forward to the Provisional Electoral Council and the Ministry of Economy and Finance (MEF), a detailed financial statement, signed by a chartered accountant, accompanied by supporting documents relating to the said subsidy in the context of elections

If the party or political group fails to comply with this obligation, it is prohibited from any political activity for at least five (5) years and not more than ten (10) years to be pronounced by the BCEN [Office of the National Electoral Litigation] at the convocation of the President of the CEP. After the thirty (30) days period provided for in the above paragraph, the Provisional Electoral Council or the Haitian State denounces the fact, for the purpose of legal proceedings at the Correctional Court for misappropriation."

Article 135 :

"Thirty (30) days after the proclamation of the final results, any legal representative of any political party or political group must forward to the CEP a detailed and complete list of all donations and donors as well as the financial report of the campaign duly signed by a chartered accountant."
