Haiti - Elections : 15 appeals of BCEDs' verdicts

After the treatment of 111 cases of contestation in the BCEDs across the country https://www.haitilibre.com/en/news-11714-haiti-security-drastic-strengthening-of-security-in-the-airport-area.html 15 cases will be appealed of the BCEDs' decision, at National Office of Electoral Disputes (BCEN). All departments are concerned with the exception of the Department of North and Northwest where no case is challenged on appeal.

On Tuesday, the Provisional Electoral Council in accordance with Articles 18 and following of the Electoral Decree, conducted the draw to form the three sections of the BCEN that must treat the fifteen appeals lodged. Note that for the first time judges will be involved directly in the hearings.

At the end of the draw attended by the Peace Judge of Petion-ville, Magistrate Léa Charlotin, assisted by the Clerk, Nathalie Sanon, the three sections of the BCEN are each constituted of two electoral advisers, two lawyers and a Magistrate professional, with the following compositions :

First section

Adviser Yolette Mengual, President ;

Adviser Néhémy Joseph, member ;

Me Pierre Widly Charles, member ;

Me Jugnace Pierre, member ;

Magistrat Frantz Drice (Court of Appeals of Les Cayes).

Section Two

Adviser Ricardo Augustin, President ;

Adviser Jaccéus Joseph, member ;

Me Rober Jean-Louis, member ;

Me Gamaël Dieudonné, member ;

Magistrat Cluny Pierre Jules (Court of Appeals of Gonaives).

Third Section

Adviser Vijonet Demero, President ;

Adviser Marie Carmel Paul Austin, membre ;

Me Marc Rhéal Cadet, member ;

Me Rousse Célestin, member ;

Magistrat Mimose A. Janvier (Court of Appeal of Port-au-Prince).

In the appeal, the case of the First Lady Sophia Martelly will undoubtedly be the most followed. Former Senator Louis Gerald Gilles, who initiated the appeal, said his lawyer has evidence that the First Lady has neither nationality or the Haitian citizenship. After having accused her of having dual nationality, the first lady she would now be stateless...? Recall that the BCEN decisions are final and without appeal.

These appeals are delaying all the publication of the list of parliamentary candidates, list that should not be released until Friday at the earliest, given the deadlines provided in the Electoral Decree (Notice period and trial period).
