Haiti - Justice : 3 members of the CSPJ protest against the interference of the Executive

In a joint statement issued on October 10, Me Jacques Letan, Me Max Elibert and Me Dilia Lemaire three members of the Superior Council of the Judiciary (CSPJ) protest against the interference of the executive power in the functions of the judiciary.

They note that interference particularly in :

"the non-renewal of contract of the Technical Secretary of the Council, unilaterally decided by the President Anel Alexis Joseph, at the request of the executive annoyed at being reminded that the CSPJ is not a body under the authority of a Minister;

The non-renewal of the mandate of many judges and investigating judges, including the magistrate Gustave Pharaoh, representative of the judges of courts of first instance despite the repeated notice of the Council, before the opening of the judicial year 2014-2015;

The appointment, transfer and dismissal of several judges of Peace without reason and without prior notice of the council, by the Minister of Justice, approved by the Prime Minister, while the head of government has not to intervene in the process of appointing of judges."

These three members of the CSPJ "strongly condemns the inappropriates conduct of the Executive power which encroach on the powers of the CSPJ" and urges once again "the Executive to stop these bad practices in violation of the principle of separation of powers enshrined in the Constitution power" they also ask Anel Alexis Joseph, President of the CSPJ "to demonstrate its ability to carry out its responsibilities by ceasing to violate the principle of collegiality in the adoption of its unilateral measures."
